Okay, I think the best way to answer this is to say that McDonald's is in the wrong for selling coffee like that, but that they should not be fined for such behaviour, since it is not illegal, and that the buyer should beware.
By best, I mean the way that would make the most people happy.

Looks like we (Democrats) will just have to ride this one out...

civil suits are also the last recourse of ordinary people such as the family of Nicole Brown Simpson against defendants who are so wealthy or powerful as to be virtually immune to prosecution.
this also justifies the size of lawyer's fees, as the corporation will easily spend just as much on their own team of lawyers.
the civil court system is the last equalizer between the rich and the poor, the powerful and the weak.

Perhaps Congress should take the matter up. There are always some people trying to legislate common sense....–
